THIS IS A LEGALLY BINDING AGREEMENT. IT GIVES UP YOUR RIGHT TO SUE AND TO RECOVER DAMAGES IF YOU ARE INJURED OR KILLED, INCLUDING INJURY CAUSED BY THE NEGLIGENCE OF THE PARTIES RELEASED BELOW.\n\n1. The Event. This Agreement applies to the Exile Skimboards Pro\/Am Skimboard Contest (“Oktoberfest”) held at Balboa Pier, Newport Beach, California, on the date or dates identified in the entry or registration form I am submitting with this Agreement, which is incorporated here by reference. The “Event” includes all practice, warm-up, heats, set-up, tear-down, awards, and related activities, and any rescheduled, extended, continued, or relocated date or site for the same contest. I am entering as a competitor, volunteer, or other participant (each, a “Participant”).\n\n2. Released Parties. “Released Parties” means, individually and collectively: Exile Skimboards LLC and its owners, members, officers, employees, contractors, and agents; the City of Newport Beach and its City Council, elected and appointed officials, officers, employees, agents, volunteers, Marine Safety\/lifeguard personnel, and representatives; the County of Orange and the State of California; all sponsors, co-sponsors, vendors, and promoters; all contest directors, judges, officials, staff, medical personnel, and volunteers; the owners, lessees, and operators of the Event site; and all other persons or entities associated or connected with the Event, and each of their respective insurers, successors, and assigns.\n\n3. Assumption of Risk. I understand that skimboarding is a hazardous activity that can cause serious injury, permanent disability, paralysis, and death. I voluntarily assume all risks, both known and unknown, of participating in or assisting with the Event, including but not limited to: shore break and wave impact; being driven into the sand or ocean floor, causing head, neck, and spinal injury; drowning, near-drowning, and rip and longshore currents; collisions with other participants, spectators, boards, the pier, pier pilings, rocks, jetties, or submerged or hidden objects; cuts and impact injuries from the sharp edges, rails, and mass of skimboards, and from the buoyancy of a board acted upon by ocean forces; sudden changes in sand contour, tide, surf, weather, wind, and water quality, including bacterial contamination and runoff; marine life; sunburn, heat illness, and hypothermia; equipment failure; the acts, omissions, or negligence of other participants, spectators, or third parties; and the condition of the beach, parking, and access areas. I understand that the risks of the Event may be increased by these conditions and that the ocean and beach are inherently dangerous and constantly changing. I further acknowledge that these risks include the ordinary negligence of the Released Parties, and I expressly assume that risk as well.\n\n4. Inspection and Personal Responsibility. I agree to inspect the contest site and satisfy myself that the area and the conditions are safe before I participate or assist, and I agree that I will not participate or assist unless I am satisfied that they are safe. I understand that no Released Party owes me any duty to inspect the site, to warn me of conditions, or to make conditions safe, and that no lifeguard, safety, or rescue personnel are guaranteed to be present or able to reach me. If at any time I believe conditions are unsafe, I will immediately stop participating and notify a contest official. I am solely responsible for my own equipment, personal property, and transportation, and no Released Party is liable for loss, theft, or damage to my property.\n\n5. Physical Condition and Medical Consent. I represent that I am in good physical health, am a competent ocean swimmer, and have no medical condition that would make my participation unsafe. I authorize the Released Parties to obtain or administer first aid, ocean rescue, and emergency medical treatment for me if I am injured and unable to consent, and I accept full financial responsibility for that treatment and transport. I understand that no Released Party provides medical or accident insurance for me, and I am responsible for maintaining my own health insurance.\n\n6. Rules. I agree to read, understand, and comply with all Exile Skimboards Pro\/Am rules and regulations, all instructions of contest officials and City of Newport Beach personnel, and all posted beach rules, City ordinances, and permit conditions. I will not participate under the influence of alcohol, cannabis, or any drug that impairs my ability to participate safely. I understand that I may be disqualified and removed from the Event for any violation, without refund of my entry fee.\n\n7. Release and Waiver of Claims. In consideration of being permitted to enter, participate in, or assist with the Event, I, for myself and for my heirs, executors, administrators, personal representatives, spouse, family, and assigns, hereby RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE the Released Parties from and against any and all claims, demands, actions, causes of action, liabilities, losses, costs, attorneys’ fees, and damages of any kind — including personal injury, disability, death, and property damage — that arise out of or relate in any way to my presence at, travel to or from, participation in, or assistance with the Event, WHETHER CAUSED BY THE ORDINARY NEGLIGENCE OF ANY RELEASED PARTY OR OTHERWISE, to the fullest extent permitted by California law. This release does not apply to gross negligence, recklessness, or willful or wanton misconduct, or to any liability that may not lawfully be released.\n\n8. Waiver of California Civil Code § 1542. I expressly waive the protections of California Civil Code § 1542, which reads: “A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.” I understand this means this release covers claims I do not now know or suspect exist.\n\n9. Indemnification. I agree to indemnify, defend, and hold harmless the Released Parties from and against any claim, demand, suit, judgment, loss, cost, or expense (including reasonable attorneys’ fees) brought by me or by any third party arising out of my presence at, participation in, or assistance with the Event, or out of my acts, omissions, or violation of the rules — including any claim brought on my behalf by a parent, guardian, family member, heir, or insurer.\n\n10. Media Release. I grant Exile Skimboards LLC, the City of Newport Beach, Event sponsors, and their assigns and media partners a non-exclusive, perpetual, worldwide, royalty-free, irrevocable right and license to record, photograph, film, and broadcast me at the Event, and to use my name, image, likeness, voice, hometown, and results in any medium now known or later developed, for reporting, promotional, commercial, and archival purposes, without further notice, approval, or compensation. I waive any right to inspect or approve such use and any claim for invasion of privacy, right of publicity, or defamation arising from it.\n\n11. Participants Under 18. If the Participant is under 18 years of age, this Agreement must be completed by the Participant’s parent or legal guardian, who states: I am the parent or legal guardian of the minor Participant; I have legal authority to enter this Agreement on the minor’s behalf; I have read and explained it to the minor; I consent to the minor’s participation and to emergency medical treatment for the minor; I release and waive, on my own behalf and on the minor’s behalf, all claims described above; and I agree to indemnify, defend, and hold harmless the Released Parties from any claim brought by or on behalf of the minor, including any claim arising from any right of the minor to disaffirm this Agreement.\n\n12. General. This Agreement is governed by the laws of the State of California, without regard to conflict-of-law rules, and venue for any dispute shall be in the state or federal courts serving Orange County, California. If any provision is held unenforceable, the remaining provisions remain in full force and effect, and the unenforceable provision shall be enforced to the greatest extent permitted by law. This is the entire agreement between me and the Released Parties regarding this subject, and no oral statement modifies it. I have had the opportunity to ask questions and to consult an attorney.\n\n13. Acknowledgment and Electronic Signature. I have read this entire Agreement, I understand it, I understand that I am giving up substantial rights including the right to sue, and I sign it freely and voluntarily without any inducement. I agree that checking the box below and typing my name constitutes my signature under the California Uniform Electronic Transactions Act (Cal. Civ.
